This website, takumibaseball.com, is operated by Palvia Inc., a company based in Tokyo, Japan ("Takumi Baseball," "we," "us" or "our"). We sell pre-owned baseball gloves from Japan to customers in the United States.
By visiting our site or buying from us, you agree to these Terms of Service, along with our Shipping Policy, Refund Policy and Privacy Policy. Please read them carefully. If you do not agree, please do not use our site.
1. Using our site
- You must be at least 18 years old to buy from us, or use the site with the involvement of a parent or guardian.
- You agree not to use our site for any unlawful purpose, to interfere with its security or operation, or to send spam, viruses or harmful code.
- We may refuse service, close an account or cancel an order at any time, for example if we suspect fraud or misuse.
2. Your account
If you create an account, please keep your login details safe. You are responsible for all activity under your account. Contact us right away if you think someone else has used it.
3. Our gloves and descriptions
Every glove we sell is pre-owned and one of a kind. We inspect, clean and photograph each glove, and we describe its condition as accurately as we can. Pre-owned gloves show signs of use, and colors may look slightly different on your screen. Please check all photos and details before you buy, and ask us if you would like more photos or a video.
Our gloves are made for Japanese and international hardball (baseball) play. It is your responsibility to check that a glove meets the rules of your league.
4. Prices and payment
- All prices are in U.S. dollars and include free shipping and U.S. import duties. Any U.S. sales tax that applies is shown at checkout.
- We may correct errors in prices or descriptions at any time. If a glove was listed at the wrong price, we may cancel the order and release your payment hold.
- When you place an order, your payment is only authorized (held), not charged. We charge it after we confirm the glove is still available.
5. Orders
Your order confirmation email means we have received your order. It does not mean we have accepted it. Our gloves are also sold in our shop in Japan, so a glove can occasionally sell there first. The sale is complete when we confirm the glove is available and charge your payment. If the glove is no longer available, we cancel your order and release the hold, and you are not charged.
6. Shipping and risk of loss
We ship to the United States only, as described in our Shipping Policy. We are responsible for your glove until it is delivered to your shipping address. If it is lost or damaged on the way, we will handle it as described in our Shipping Policy.
7. All sales are final
Because our gloves are pre-owned and one of a kind, all sales are final, except in the cases described in our Refund Policy.
8. Reviews and other content you send us
If you send us reviews, photos, comments or ideas, you allow us to use, copy and publish them in connection with our business. Please do not send anything that is unlawful, offensive, misleading or that belongs to someone else. We may remove any content at our discretion.
9. Intellectual property
The content of this site, including text, photos, graphics and logos, belongs to Takumi Baseball or its licensors and is protected by copyright and other laws. You may not copy or reuse it without our written permission. Brand names and logos of glove makers belong to their owners. We are an independent reseller and are not affiliated with or endorsed by those brands.
10. Third-party links and services
Our site may link to, or use, services provided by others, such as Shopify, payment providers and Japan Post. We are not responsible for their websites or services, which are governed by their own terms.
11. Limitation of liability
To the fullest extent permitted by law, Takumi Baseball is not liable for any indirect, incidental or consequential damages arising from your use of our site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any rights you have that cannot be limited by law.
12. Indemnification
You agree to defend and hold Takumi Baseball harmless from any claims or costs arising from your breach of these Terms or your misuse of our site.
13. Electronic communications
When you contact us or place an order, you agree to receive communications from us electronically, such as by email. These communications meet any legal requirement that they be in writing.
14. Governing law and disputes
These Terms are governed by the laws of Japan. If you have a concern, please contact us first. Most issues can be solved quickly. Any dispute that cannot be resolved will be subject to the exclusive jurisdiction of the Tokyo District Court in Japan as the court of first instance.
15. Changes and severability
We may update these Terms at any time by posting the new version on this page. Changes apply to orders placed after they are posted. If any part of these Terms is found invalid, the rest remains in effect.
